TERMS AND CONDITIONS

Article 1 – Kayanova

Kayanova is a French law limited company (SAS) with its registered office in Boeschepe, France. Kayanova also has an operational establishment in Montbrun-des-Corbières, France.

Article 2 – Applicability of the terms and conditions

These terms and conditions apply to all retreats offered by Kayanova via kayanova.eu. They apply to all retreats, workshops, seminars and events listed on these websites and form an integral part of any agreement regarding participation in these activities. The terms and conditions of the instructors/organizers involved also apply.

Article 3 – Retreats

The standard retreats offered by Kayanova include the stated overnight stays, full board and any tuition fees. The content of a retreat may vary according to the wishes of the participant(s).

Article 4 – Retreat information

Kayanova guarantees that all information relevant to the retreat is available on the website before the participant continues the booking process. This information includes at least:

general information about the retreat, workshop or seminar;
information about the accommodation/room;
(optional) information about transfers
(optional) information about additional services;
payment conditions.
If the retreat is described in a Kayanova publication, this information forms part of the agreement.

If Kayanova’s general provisions conflict with the terms and conditions of a third party providing a service (for example, an instructor), the terms and conditions of that third party prevail.

Kayanova is not liable for general information contained in photos, brochures, advertisements, websites or other sources of information drawn up under the responsibility of third parties.

Article 5 – Formation and content of the agreement

Offer and acceptance: The booking is concluded as soon as the participant accepts Kayanova’s offer by completing the booking process on the website. The participant will then receive a confirmation, in writing or electronically, possibly in the form of an invoice. The online booking process is designed in such a way that it is clear before confirmation that acceptance of the offer leads to a definitive booking. From the moment of confirmation, the participant is bound by the agreement.

By accepting the offer, the participant also agrees to the terms and conditions of external service providers, such as instructors or organizers.

Article 6 – Participant’s obligation to provide information

The participant provides Kayanova, before or when the agreement is concluded, with all information about themselves and any fellow travelers that is relevant to the execution of the retreat. This includes at least a mobile telephone number and e-mail address. The participant must also provide information about characteristics or the composition of the group that may be relevant to correct execution. If the participant fails to comply with this obligation to provide information and Kayanova is therefore forced to exclude people from (further) participation, all resulting costs will be borne by the participant.

By accepting the offer, the participant also agrees to the terms and conditions of external service providers, such as instructors or organizers.

Article 7 – Withdrawal of the offer

Kayanova’s offer is without obligation and can be withdrawn if necessary. Withdrawal to correct calculation errors or other mistakes is permitted. In such cases, the participant is entitled to immediate reimbursement of amounts already paid.

By accepting the offer, the participant also agrees to the terms and conditions of external service providers, such as instructors or organizers.

Article 8 – Obvious errors

Obvious errors or clear mistakes do not bind Kayanova. These are errors that a reasonably acting consumer should immediately recognize as such.

Article 9 – Essential medical requests

The participant may request changes or additions to the retreat on medical grounds. Kayanova will make every effort to honor such requests, unless this cannot reasonably be required of it. Written approval is required. Kayanova may charge costs, including organizational costs of up to €50 per booking, additional costs from service providers and communication costs.

Article 10 – Non-essential medical requests

Requests on non-medical essential grounds will only be processed if there is a reasonable chance that they can be granted. Written approval is also required for these requests. Kayanova may charge €50 administrative costs per booking, as well as any additional costs from service providers.

Article 11 – The participant

The person who enters into the agreement on behalf of or for the benefit of other persons is jointly and severally liable for all obligations arising from the agreement. All communication and payments are made exclusively via the participant. Each participant is personally responsible for his or her own obligations.

Article 12 – Payment

For online bookings, 50% of the full amount must be paid immediately, in accordance with the invoice provided. The remaining 50% must be paid 45 days before the start of the relevant retreat in accordance with the invoice provided.

If the online booking takes place within 45 days before the start of the retreat, the full amount must be paid for 100% in accordance with the invoice provided.

Kayanova accepts the payment methods offered during the online booking process.

Kayanova offers no refund. Cancellation insurance must be provided by the participant.

Article 13 – Retreat price

The stated retreat price applies per retreat, unless stated otherwise, and is based on the prices, exchange rates, levies and taxes that were known at the time of publication. The invoice includes all essential parts of the retreat.

Article 14 – Retreat documents

After payment, the participant will receive a confirmation email, which serves as check-in documentation. If the documents have not been received at least 5 working days before the start of the retreat, the participant must inform Kayanova immediately. For bookings within 10 days before the start, Kayanova will indicate when and how the participant will receive the necessary documents. If documents are still not received on time, the participant must report this immediately.

Article 15 – Information about the retreat, workshop or seminar

All information about the event is made available in advance by Kayanova via the website. This information is based on data from the organizer.

Article 16 – Obligations of the participant(s)

Participants must follow all instructions from Kayanova and from the service providers involved, such as instructors or organizers.

Article 17 – Assistance

Kayanova provides appropriate assistance, depending on the circumstances, if the retreat does not meet the legitimate expectations based on the information provided. If the cause is due to the participant, assistance will be provided to the extent that this is reasonably possible; in that case, the costs will be borne by the participant. If shortcomings cannot be attributed to either the participant or Kayanova, each party will bear its own damage.

Article 18 – Travel documents

The participant is responsible for obtaining the required travel documents in time, for checking whether previously obtained information is still valid, and for possessing all necessary documents (passport, identity card, visas, vaccination certificates, driving license, etc.).

Article 19 – Changes by the participant

After the agreement has been concluded, the participant may request changes, provided they are available. Any price differences must be paid. If a change request is rejected, the participant can keep or cancel the original booking (in accordance with Article 20). If the participant does not respond, the original booking remains in effect.

Article 20 – Change of participant

The participant can be replaced by another person, provided this is arranged in time. Administration and communication costs may be charged. Conditions for substitution: the replacement meets all requirements of the agreement; service providers accept the replacement and their conditions are complied with; the request is submitted no later than 7 days before the start or in sufficient time to complete all formalities. The original participant, the applicant and the replacement are jointly and severally liable for all outstanding amounts and any costs.

Article 21 – Cancellation by the participant

After completing the booking process and payment, cancellation by the participant is non-refundable.

Article 22 – Cancellation by Kayanova

Kayanova may cancel the retreat due to compelling circumstances. Compelling circumstances are circumstances that make execution of the retreat impossible and cannot reasonably be attributed to Kayanova. If the cause is due to the participant, the participant will bear the resulting damage. If the cause is due to Kayanova, the full amount will be refunded. If the cause is not due to either party, each party will bear its own damage. If the organizer cancels the event, Kayanova will only reimburse the retreat costs. Other costs incurred by the participant will not be reimbursed.

Article 23 – Changes by Kayanova

Kayanova may change the retreat for compelling reasons. The participant will be informed of this within 72 hours (or within 24 hours if the retreat takes place within 7 days). If possible, an alternative will be offered within the same period. The alternative must be equivalent to the original offer. The participant can refuse the change or the alternative within the same periods. In the event of refusal, Kayanova may terminate the booking with immediate effect. The participant is then entitled to a refund of (the remaining part of) the retreat price within 2 weeks. If the cause lies with Kayanova, the participant’s damage will be compensated. If the cause lies with the participant, the participant will bear the damage. If the cause lies with neither party, each party will bear its own damage.

Article 24 – Liability and force majeure

Kayanova executes the retreat in accordance with the legitimate expectations based on the information provided. If the retreat deviates from this, the participant must report this as soon as possible. In case of force majeure, Kayanova is not liable. Force majeure includes exceptional and unforeseeable circumstances beyond Kayanova’s control, the consequences of which could not be avoided despite all due care.

Article 25 – Exclusion and limitation of liability

Kayanova executes the retreat in accordance with the legitimate expectations based on the information provided. If the retreat deviates from this, the participant must report this as soon as possible. In case of force majeure, Kayanova is not liable. Force majeure includes exceptional and unforeseeable circumstances beyond Kayanova’s control, the consequences of which could not be avoided despite all due care.

Article 26 – Disputes and applicable law

These terms and conditions are governed by French law. Disputes will be submitted exclusively to the competent court.
